However, since the summer of 2024, McDonald\u2019s Netherlands has been violating the law by offering single-use cardboard cups with plastic coating in its restaurants. As a result, the country\u2019s largest fast-food chain is not only non-compliant and wasting resources, but is even making customers pay extra by charging a fee for these single-use cups. <\/i><\/p>\n<h2><b>McDonald\u2019s makes extra money from customers while breaking the law<\/b><\/h2>\n<p>All caf\u00e9s, restaurants, and hotels serving food and drinks for on-site consumption must provide these in reusable packaging<a href=\"#voetnoten-en-mcdo\"><span id=\"footnote-ref-0\" style=\"position: relative; font-size: 9px; line-height: 0; vertical-align: baseline; top: -0.5em;\">[1]<\/span><\/a>. This law has been in force in the Netherlands since January 2024, as part of the implementation of European regulations. The aim is to reduce the use of single-use packaging containing plastic. Since August 2024, McDonald\u2019s has been violating this law<a href=\"#voetnoten-en-mcdo\"><span id=\"footnote-ref-1\" style=\"position: relative; font-size: 9px; line-height: 0; vertical-align: baseline; top: -0.5em;\">[2]<\/span><\/a> by reintroducing single-use paper cups with plastic coating for on-site consumption (for beverages and McFlurries). In addition, the restaurants charge customers \u20ac0.15 per single-use cup, even though this \u2018SUP surcharge\u2019 may only be applied to take-away packaging. Competitors\u2014both large chains and small businesses\u2014who do follow the law and contribute to a real circular packaging system suffer from an uneven playing field. This is why Fair Resource Foundation submitted an <a href=\"https:\/\/fairresourcefoundation.org\/wp-content\/uploads\/2025\/11\/Samenvatting_M-2025-0704449.pdf\" target=\"_blank\" rel=\"noopener\">enforcement request<\/a> to the Dutch authorities on November 26.<\/p>\n<p>&nbsp;<\/p>\n<h2>McDonald\u2019s makes reuse fail. In the <a href=\"https:\/\/euobserver.com\/investigations\/ar8e744482\" target=\"_blank\" rel=\"noopener\">European Union<\/a>, it does so through the <a href=\"https:\/\/foodservicefootprint.com\/exclusive-academics-call-out-mcdonalds-and-the-eppa-for-misleading-packaging-reports\/\" target=\"_blank\" rel=\"noopener\">widely criticized<\/a> <em>No Silver Bullet<\/em> <a href=\"https:\/\/nosilverbullet.eu\/\" target=\"_blank\" rel=\"noopener\">campaign<\/a>, and in the Netherlands through conversations with, among others, former State Secretary <a href=\"https:\/\/www.linkedin.com\/posts\/chris-jansen-71288718_we-kennen-mcdonalds-allemaal-van-de-hamburgers-activity-7289603414651551744-EZxE\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAAK_AYgB6dYb7ResgIMEDBMEip6RFrSQu38\" target=\"_blank\" rel=\"noopener\">Chris Jansen<\/a>, Special Government Representative for the Circular Economy <a href=\"https:\/\/www.linkedin.com\/posts\/mcdonald-s-nederland-b-v-_mcdonaldsnederland-circulaireeconomie-ingesprek-activity-7374101428153507840-Uz0y\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAAK_AYgB6dYb7ResgIMEDBMEip6RFrSQu38\" target=\"_blank\" rel=\"noopener\">Steven van Eijck<\/a>, and various <a href=\"https:\/\/www.khn.nl\/nieuws\/tweede-kamerlid-erik-haverkort-vvd-brengt-werkbezoek-aan-mcdonalds-in-samenwerking-met-khn\" target=\"_blank\" rel=\"noopener\">members of parliament<\/a>. The chain also <strong>influences public opinion<\/strong> by portraying reuse as \u201c<em>bad for the environment<\/em>\u201d in <a href=\"https:\/\/www.verpakkingsmanagement.nl\/opinie\/impact-van-sup-wetgeving-op-fastfoodketens\" target=\"_blank\" rel=\"noopener\">interviews<\/a> and (sponsored) articles in national and international media (<a href=\"https:\/\/www.politico.eu\/sponsored-content\/no-silver-bullet-ensuring-the-right-packaging-solutions-for-europe\/\"><span style=\"font-weight: 400;\">2023<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.nu.nl\/advertorial\/advertorial-mcdonalds\/6337121\/zijn-herbruikbare-bekers-de-beste-keuze-voor-het-milieu-praat-mee.html\"><span style=\"font-weight: 400;\">2024<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.nu.nl\/advertorial\/advertorial-mcdonalds\/6342178\/hoe-de-beker-van-je-mcflurry-een-tweede-derde-of-vierde-leven-krijgt.html\"><span style=\"font-weight: 400;\">2025<\/span><\/a>). But perhaps even more importantly: <strong>McDonald\u2019s Netherlands is deliberately letting its own reuse system fail<\/strong>.<\/p>\n<p>The <a href=\"https:\/\/www.mcdonalds.com\/content\/dam\/sites\/nl\/nfl\/publications\/McD%20PROD%20Impact%20Report%202025%20DEF2.pdf\" target=\"_blank\" rel=\"noopener\">impact report<\/a> states that their reusable cups are reused only 3.3 times on average in Dutch restaurants. This number is far lower than in well-designed, effective reuse systems. The fast-food giant &#8211; larger than KFC and Burger King combined (the <a href=\"https:\/\/www.linkedin.com\/posts\/packbacknetwork_burgerking-duiven-smartreuse-activity-7395063697276035072-rmlT\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAAwvHH0BMoSpsaP_apzjEsc2unxsetzTrZU\" target=\"_blank\" rel=\"noopener\">latter<\/a> proves reuse can work through consumer-friendly systems)\u2014is therefore not complying with <a href=\"https:\/\/www.ilent.nl\/onderwerpen\/kunststofproducten-voor-eenmalig-gebruik\" target=\"_blank\" rel=\"noopener\">Dutch rules on single-use cups<\/a>. For this reason, Fair Resource Foundation has submitted an <a href=\"https:\/\/fairresourcefoundation.org\/wp-content\/uploads\/2025\/11\/Samenvatting_M-2025-0704449.pdf\" target=\"_blank\" rel=\"noopener\">enforcement request<\/a> to the Dutch authorities (ILT).<\/p>\n<p>In addition, by deliberately designing a poor reuse system and then blaming the concept of reuse itself, the chain threatens the rise of the Dutch circular industry. This can only be achieved by eliminating packaging altogether or by introducing reuse systems. Mandatory reuse is therefore an effective, data-driven solution to the single-use culture we have created together.<br \/>Burger King, McDonald\u2019s biggest competitor, <a href=\"https:\/\/www.linkedin.com\/posts\/packbacknetwork_burgerking-duiven-smartreuse-activity-7395063697276035072-rmlT\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAAwvHH0BMoSpsaP_apzjEsc2unxsetzTrZU\" target=\"_blank\" rel=\"noopener\">demonstrates<\/a> that reuse does work through consumer-friendly systems, including in the fast-food sector. By influencing legislation, steering public opinion, and allowing its own reuse system in the Netherlands to fail, McDonald\u2019s is trying to get its way. Furthermore, enforcement is indispensable, and holding the most influential fast-food company, which is breaking the law, accountable would make a significant difference.<\/p>\n<p>&nbsp;<\/p>\n<p>Finally, we call on McDonald\u2019s to <a href=\"https:\/\/www.mcdonalds.com\/nl\/nl-nl\/goed-om-te-weten\/scale-for-good.html\" target=\"_blank\" rel=\"noopener\">take responsibility<\/a> and respect the law, stop resisting, and stop charging customers for prohibited single-use packaging. As market leader, McDonald\u2019s sets the direction for the market.
